Please read the Licence Agreement very carefully.
By using the BeST e-learning program, you are agreeing to be bound by the terms and conditions stated below.
The Royal College of Surgeons in Ireland ("RCSI") and its agent, IntuMed may revise and update these Terms and Conditions at anytime. Your continued usage of BeST Online will mean you accept those changes.
- Licence: This is a Licensing Agreement between you and RCSI. Upon completion of registration and payment requirements, RCSI grants to you a non-exclusive, non-transferable licence to use BeST in accordance with these terms and conditions. You will obtain access to the e-Learning program, the tests, the associated services, the links to other sites, discussion groups and other resources provided by RCSI ("BeST"). This is not a sale. RCSI retains the title to the program and related documentation, if any. BeST is for your own educational, non-commercial use only. By using BeST, you agree to abide by the terms and conditions of this Agreement.
- Restrictions: Your licence includes the following restrictions:
- Your user name, password and/or secrets should not be given to any other person. The RCSI and its agent, IntuMed reserve the right to terminate this user licence if more than one person attempts to access this system using the same username and password. In such case, no refund will be granted. Please keep your user and password details secure at all times.
- You will not lease, rent, loan, sell, place on a network, sub-licence, distribute or otherwise transfer BeST or any derivative work based on BeST, or any part of it to any third party.
- Trademarks, logos, site design, content and images placed on the website are the property of RCSI or third parties, and are protected by Irish and European Union copyright laws and other international copyright laws and conventions. You agree not to copy, publish, modify, post, upload, reproduce, distribute or in any other way exploit BeST in whole or in part except as set out in this Agreement. You acknowledge that all rights relating to such trademarks, copyright and any other intellectual property rights are reserved for RCSI or the organisation contributing the relevant materials.
- You agree not to remove, alter or hide any copyright notice, logo, trademark or other proprietary notice delivered in BeST.
- The program contains copyrighted material, trade secrets, and other proprietary material. You agree not to copy, decompile, reverse engineer or disassemble BeST except as permitted by law.
- You agree not to publish defamatory, deceptive, abusive, offensive, pornographic or otherwise illegal materials in BeST.
- You agree that RCSI may publish your messages in full or in part. You hereby waive any and all rights to any ideas, drawings, opinions, and other creative materials posted on BeST.
- Termination: The licence is effective for 12 months from the date of registration. You may terminate this Agreement at any time by e-mailing your registration details and desire to terminate to inquiries@IntuMed.com. You will receive confirmation of termination by e-mail response. If you fail to comply with the these terms and conditions, the license will terminate immediately without notice.
- Cancellation: You have ten days to cancel your subscription for BeST from the date of registration. You will be refunded the subscription less any administrative fees for processing the transaction. After this ten-day period, refunds will be given at the discretion of the Company.
- Links to Other Sites: The sites linked to BeST are not under the control of RCSI, and RCSI does not assume any responsibility for the accuracy or reliability of any information, data, opinion, advice made on these sites. RCSI does not endorse nor sponsor any links provided.
- Limited Liability: You expressly acknowledge that use of BeST is at your sole risk. RCSI, its directors, officers, employees, or suppliers assume no responsibility for any loss and/or damages arising out of the use or inability to use BeST. This exclusion may not apply, in full or in part, in certain jurisdictions. In no event shall the RCSI’s total liability exceed the total amount paid for BeST.
- Indemnity: You are solely responsible for the content of your messages and e-mails. You hereby indemnify RCSI, its directors, staff, tutors, contractor, licensors and service providers for any losses, damages costs, expenses (including legal fees) or liabilities incurred as a result of any communication claimed to be defamatory, obscene, or otherwise unlawful, or which violates copyright, trademark, proprietary or other rights of third parties.
- Disclaimer of Warranty: Surgery is an ever-changing field. While RCSI has ensured that all dosages, applications, techniques, and other information are accurate and based on current practices, you should check product information currently provided by manufacturers of specific products, and the relevant authorities in the country in which you are practising. RCSI cannot guarantee the information contained on this website is accurate, or that the operation and/or delivery of BeST will be error free or uninterrupted. RCSI disclaims all warranties, express or implied, including without limitation the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. Any opinion expressed or posted in BeST is the opinion of the individual author or editor and not necessarily the opinion of RCSI. RCSI reserves the right to change or discontinue, without notice, any aspect or feature of the content and/or the BeST website.
- Privacy Statement: By using BeST, you hereby consent to the information gathering and dissemination practices as set forth in the Privacy Statement.
- Monitoring: RCSI reserves the right to monitor message boards, forums, tutor links, and other community based services either existing or added over time. RCSI has the right to edit, modify, refuse to post, or remove any material submitted for BeST at its sole discretion.
- Controlling Law, Jurisdiction, and Severability: This Agreement shall be governed by the laws of the Republic of Ireland, and the parties hereby consent to the jurisdiction of the courts in Ireland. If any provision in this Agreement is held invalid, illegal, or unenforceable, the remainder shall continue to operate to its full affect.
